In New Jersey, the state determines the severity of theft or fraud charges by calculating the value of the stolen property and the amount of force that was used in the theft. This calculation creates a sliding scale, which includes a wide range of penalties. Depending on the amount involved, these charges can be disorderly persons offenses, handled in the local municipal court, or they can be indictable criminal offenses which must be handled at the Superior Court in the County in which the alleged theft occurred.
