Penalties for First Offense Drunk Driving in New Jersey
For a first offense driving while intoxicated in New Jersey, the penalties depend on the breath test readings involved. If the defendant’s blood alcohol content (BAC) is between .08% and .10%, this is known as a “first tier” DWI violation and results in a three (3) month license suspension. If the defendant’s BAC is over .10% and it is a first DWI offense in New Jersey, the license suspension ranges from seven (7) months to one (1) year. Further, if the defendant’s BAC is .15% or higher, there is a mandatory installation of an ignition interlock device on the defendant’s vehicle during the period of license suspension and for six (6) months after the license suspension is over.
Our drunk driving defense lawyers are certified on field sobriety testing and are certified on the Draeger Alcotest machine which is used to test the defendant’s blood alcohol content (BAC) in New Jersey.
