Mine Hill NJ Shoplifting Criminal Offenses
In New Jersey, most shoplifting cases are classified as a disorderly persons offense if the amount allegedly stolen is under $200.00. These charges will be handled in the Mine Hill/Wharton Municipal Court if the alleged theft was committed in this municipality. If convicted of this charge, the maximum penalty is up to six months in jail, up to a $1,000 fine, and face a permanent criminal charge on your record.
If the amount allegedly stolen is over $200.00 but less than $75,000.00, this is a third degree offense. This matter must be handled in the Morris County Court because it is an indictable criminal offense. The third degree charge includes between three (3) and five (5) years in state prison. However, if you have no prior criminal record you can be sentenced to a probationary period since there is no presumption of incarceration.
If you are charged with a second degree, third degree, or fourth degree indictable shoplifting charge in Morris County, your matter will be scheduled for an Early Disposition Conference ("EDC"). At this time, you will be permitted to apply for the Pre-Trial Intervention (PTI) program and you will be given the State's best plea offer.
