Morris County Municipal Courts: Traffic and Disorderly Persons Offenses

Municipal courts in New Jersey handle traffic and minor criminal matters. They also handle driving while intoxicated (DWI) cases. Minor criminal matters are known as disorderly persons offenses which are similar to misdemeanors. In New Jersey, we do not have felony and misdemeanor classifications. Instead, minor criminal charges are known as disorderly persons offenses and are handled in Municipal Court. Serious criminal charges (typically referred to as "felonies" in other states) are known as "indictable" criminal charges and must be handled in the Superior Court in the County in which the alleged crime was committed. For example, if you are charged with simple assault arising from a bar fight in Parsippany, New Jersey, this is a disorderly persons offense and will be handled in Parsippany Municipal Court. However, if you are charged with aggravated assault arising out of this same bar fight (because of the nature of the injuries to the alleged victim or because a weapon was involved), this is an indictable criminal charge and must be handled in Morris County Superior Court in Morristown, New Jersey.

Disorderly persons offenses include a maximum of six (6) months in the county jail and up to a $1,000.00 fine. This will result in a permanent criminal charge on your record which will appear on background checks for future employment and educational opportunities. A disorderly persons offense can be expunged after five (5) years in certain circumstances.
